Mental health law is highly specialised, and an area in which John Fowlers Solicitors has operated a successful department for many years.
We assist those suffering from mental health problems who are being compulsorily detained under the Mental Health Act 1983 (as amended) and we attend hospitals in order to assist anyone in this situation.
The department is made up of very experienced practitioners, all of whom are members of the Solicitors’ Regulation Authority Mental Health Tribunal accreditation scheme, and they are also members of the Mental Health Lawyers’ Association.
We can advise on all issues which may arise in respect of:
- Detention for Assessment (Section 2) Order
- Detention for Treatment (Section 3) Order
- Community Treatment Order (CTO, Section 17A)
- Hospital and Restricted Hospital Orders (Sections 37/41)
- Transfers to Hospital and Restriction Orders (Sections 47/49)
We can advise and represent clients on applications/referrals to a Mental Health Tribunal, applications to the Hospital Managers, after care arrangements, treatment and other issues affecting detained mental health patients, and those who are who are being supervised in the community.
We have extensive knowledge and expertise in assisting our clients at meetings with professional members of their treating team and attending CPA Meetings. We are also able to deal with ‘Nearest Relative’ issues in a caring and sensitive manner.
Paying for our work
John Fowlers has a mental health contract awarded by the Legal Services Commission. This means it can offer Legal Aid and act for clients free of charge in respect of all preparation work and representation at a Mental Health Tribunal hearing.
The Legal Aid available for assisting clients at Managers’ Hearing is means-tested. This means that some people will not qualify if their income or savings are too large. If you are ineligible for Legal Aid, we can advise on private funding arrangements.
