The case

A client was having difficulty with their employer. The client came to John Fowlers Solicitors, recommended by a friend who ran a local business who put them in touch with us as we had advised the business.

The employer wrongly accused the employee of wrongdoing. The employee, already unwell had their illness considerably worsened due to the unreasonable actions of the employer.

How we helped

Karen Morovic, John Fowlers Employment Law specialist, advised the client on how to handle the employer and proactively sought a settlement agreement on the client’s behalf. This resulted in a successful and speedy resolution that was able to benefit all parties involved, most of all the client.

We offer a free half hour consultation to all new clients so that if it is clear that we are not going to be able to assist them, because for example they do not have a claim, they don’t incur any charges.

In this particular matter, because the employer was keen to get the matter resolved, the case concluded in about 3 weeks with a settlement agreement being entered into.

The biggest challenge is always knowing when is the best time to settle. Emotions often run high in employment disputes and a clear, calm, head on the part of the solicitor to help guide the client is always key.

The case

John Fowlers Solicitors represented a husband whose wife alleged that he had committed a serious sexual assault against her. Prior to a full investigation, he was remanded on bail for six days. The wife continued to make allegations to the police and social services, and refused to allow the husband to spend time with his child. She sought an order barring him from returning to the family home, even though she was not living there.

John Fowlers was approached by a mother of four, who had been subjected to domestic abuse during her relationship with the father of the children. She was referred to John Fowlers by other local solicitors, who were aware of our expertise in domestic violence and mental health issues. The client suffered from mental health problems which proceeded to get worse as her situation with the Father continued. The father managed to portray the mother to professionals in a very poor light and persuaded them that the four children should live with him.

How we helped

John Fowlers organised several meetings with the client who initially was in a very chaotic state of mind and at times irrational. We offered her professional support and guidance, sensitively taking her through every step as calmly as possible. After working closely with our expert team, she turned her situation around, acting in a rational, organised, and emphatic way. After several hearings, preparation of statements, collation of information and meetings with social services, the mother was able to convince the court that the four children should return to live with her.

The case

This case involved two elderly people, husband and wife. They had been struggling with their affairs and finances for some years and the local authority had been asked to look into matters. They had children who sadly could not agree on the best way forward and there were issues of financial mismanagement that required attention.

How we helped

Christopher Andrews from our Private Law department was initially asked to assist and provide an action plan. As the case progressed, Christopher was consulted by the local authority as a specialist in Court of Protection matters as to what might be the necessary next steps. The local authority consented to Christopher’s appointment as Deputy for the couples financial affairs, so as to take over the role that the local authority had been previously carrying out.

This was also with the consent of the children involved in the case who felt that it would be appropriate for a specialist from John Fowlers to act and be an impartial member of the case and would be able to put matters in good order. They both felt comfortable talking to Christopher and explain openly what had previously happened.

Numerous meetings took place with family members and the local authority which allowed a paper application to be made to the Court of Protection rather than an oral (and costly) meeting being required. It was important throughout to make sure that all parties were clear that their concerns and feelings were being taken into account at all stages so as to minimise any contention.

The application and subsequent arranging of finances for the couple lasted around 9-12 months which included the matter of a complicated previous property transaction, however, this was settled without the need for a further Order of the Court and was agreed by consent. Christopher subsequently acted for the couple up until their respective deaths.

Any challenges faced by Christopher and his team during this case were dealt with in a calm and caring way, taking into account the fact that people all have different opinions, none of which are more important than any others and every effort was made to make sure that the family and local authority and interested parties knew what was being done and importantly why. This allowed better interaction between parties and a better understanding of the process for them which in turn created a better level of cooperation and trust.

The couple were very happy that their affairs were looked after properly and this was a relief to everyone involved, there was a clear separation between the role of family and that relating to the finances of the couple.
